Invoicing Fraud and Procurement Irregularities in Sierra Leone

An Office of the Inspector General (OIG) investigation found evidence of fake invoices and fictitious vendors in the procurement of office equipment for the Sierra Leone Ministry of Health and Sanitation, a Principal Recipient of Global Fund grants.
In an assessment of the ministry made in 2011 by the Local Fund Agent, losses of USD 167,947 were highlighted in the purchase of non-health products. In its investigation, the OIG identified a further USD 70,510 of compromised expenditure.

The OIG investigators found fake invoices dating from 2008-2011, some of which appeared to be in the handwriting of a ministry finance officer, as well as examples of suppliers who did not actually exist.
There was also evidence of bid rigging in the procurement process with ministry staff producing false quotations and multiple vendors identified as being controlled by a single entity. The practice of submitting different quotations for the same tender from a consortium of companies owned by the same entity creates the impression of fair competition when in fact there is none. 
The Global Fund is seeking to recover the compromised funds and has precluded the implicated vendors. At the Global Fund Secretariat’s request, the Ministry of Health and Sanitation has outsourced the procurement of its non-health products to the United Nations Office for Project Services (UNOPS).
The ministry held its fiduciary agent liable for the sum of USD 167,947 identified by the Local Fund Agent and recovered part of it by withholding fees owed. The ministry has since changed its fiduciary agent.
The OIG has also recommended that, in the future, grant agreements are amended to ensure optimum bookkeeping with rigorous record-keeping of each beneficiary and payment made with supporting documentation.
The Global Fund is an international financing institution that fights AIDS, tuberculosis and malaria with a 21st century approach: partnership, transparency, constant learning and results-based funding.

Pregnant Christian Woman Sentenced to Death for Refusing to Convert to Islam.

KHARTOUM, Sudan (AP) — A pregnant Sudanese woman who married a Christian man was sentenced to death Thursday after she refused to recant her Christian faith, her lawyer said.

Meriam Ibrahim, whose father was Muslim but mother was an Orthodox Christian from Ethiopia, was convicted of "apostasy" on Sunday and given four days to repent and escape death, said lawyer Al-Shareef Ali al-Shareef Mohammed.

The 26 year old, who is eight months pregnant, was sentenced after that grace period expired, Mohammed said.

Amnesty International immediately condemned the sentence, calling it "abhorrent." The U.S. State Department said it was "deeply disturbed" by the sentencing and called on the government to respect the right to freedom of religion.

Mohammed, the lawyer, called the conviction rushed and legally flawed since the judge refused to hear key defense witnesses and ignored constitutional provisions on freedom of worship and equality among citizens.

Ibrahim and Wani married in a formal church ceremony in 2011 and have a son, 18-month-old Martin, who is with her in jail. The couple runs several businesses, including a farm, south of Khartoum.

Sudan's penal code criminalizes the conversion of Muslims into other religions, which is punishable by death.

As in many Muslim nations, Muslim women in Sudan are prohibited from marrying non-Muslims, though Muslim men can marry outside their faith. By law, children must follow their father's religion.

Sudan introduced Islamic Shariah laws in the early 1980s under the rule of autocrat Jaafar Nimeiri, a move that contributed to the resumption of an insurgency in the mostly animist and Christian south of Sudan. An earlier round of civil war lasted 17 years and ended in 1972. The south seceded in 2011 to become the world's newest nation, South Sudan.

Sudanese President Omar Bashir, an Islamist who seized power in a 1989 military coup, says his country will implement Islam more strictly now that the non-Muslim south is gone.

A number of Sudanese have been convicted of apostasy in recent years, but they all escaped execution by recanting their new faith. Religious thinker and politician Mahmoud Mohammed Taha, a critic of Nimeiri and his interpretation of Shariah, was sentenced to death after his conviction of apostasy. He was executed in 1985 at the age of 76.

Mohammed said he intends to appeal Ibrahim's conviction.

"The judge has exceeded his mandate when he ruled that Meriam's marriage was void because her husband was out of her faith," Mohammed told The Associated Press. "He was thinking more of Islamic Shariah laws than of the country's laws and its constitution."

He said Ibrahim's Muslim father left her mother when she was a child and her mother raised her as a Christian.

The court in the capital, Khartoum, also ordered that Ibrahim be given 100 lashes for having what it considers sexual relations with her husband, Daniel Wani, a Christian from southern Sudan who has U.S. citizenship, according to the lawyer and judicial officials who spoke on condition of anonymity in line with regulations. Wani was acquitted of a charge of harboring an apostate, according to another defense lawyer, Eman Abdul-Rahim.

Wani fled to the United States as a child to escape the civil war in southern Sudan but later returned, she said.

Amnesty called the sentence a "flagrant breach of international human rights law."

"The fact that a woman could be sentenced to death for her religious choice, and to flogging for being married to a man of an allegedly different religion, is abhorrent and should never be even considered," Amnesty said in a statement, quoting its Sudan researcher, Manar Idriss.

Ibrahim's case first came to the attention of authorities in August, when members of her father's family complained that she was born a Muslim but married a Christian man.

They claimed that her birth name was "Afdal" and that she changed it to Meriam. Mohammed said the document produced by relatives to show she was given a Muslim name at birth was a fake. Ibrahim refused to answer Judge Abbas Khalifa when he called her "Afdal" during Thursday's hearing. Meriam is a common name for Muslims and Christians alike.

"I was never a Muslim. I was raised a Christian from the start," she said.

Authorities first charged her with having illegitimate sex last year but she remained free pending trial. She was charged with apostasy and jailed in February after she declared in court that Christianity was the only religion she knew.

Dr. Mohamed Koker Educates Sierra Leoneans about UK Medical Scandal

A Sierra Leone medical doctor trained in the former Union of Soviet Socialist Republics (USSR) and working in United Kingdom's National Health System (NHS), Dr. Mohamed Koker earlier today contacted the Segbwema Blog today with clarifications on the saga of Dr. Bai Bai Ahmed Kabia.

Dr. Bai Bai Ahmed Kabia is the Soviet trained Sierra Leone national jailed in UK for 15 months on charges of writing over 1000 fraudulent applications to UK's NHS, with the hope of securing a job as a medical doctor.

According to Dr. Koker, he too is a medical graduate from the former USSR who has been working as a medical doctor in UK's National Health System for the past 12 years. He states that there were also many Soviet trained Sierra Leone doctors working in the United Kingdom.

As foreign doctors, Dr. Koker explained that they are expected to take and pass the UK Professional and Linguistic Assessment Board Tests (PLAB) in order for them to work as medical doctors in the NHS. Many Sierra Leone USSR medical graduates took these exams, passed and are employed as doctors in UK.

He states that when he heard the story about Dr. Bai Bai Ahmed Kabia, he contacted his Sierra Leone medical colleagues, many of whom had not even heard about Dr. Kabia in the Sierra Leone UK medical community.

Dr. Koker states that he hopes that Dr. Kabia upon release will not be able to practice in Sierra Leone, given his fraudulent history. He stated "Our people can cope with poorly equipped Hospitals, but surely not with fake doctors.

Many of the Sierra Leone medical community in the UK who are USSR graduates want the world to know the Dr. Bai Bai Kabia is a bad apple among many Soviet graduates who are doing exemplary work in UK, Sierra Leone and across the world.

A Russian trained Sierra Leonean medical school graduate, Dr. Bai Bai Ahmed Kabia, is in hot waters in the United Kingdom where he has been jailed for 15 months for making up different qualifications on over 1000 fraudulent job applications in UK's National Health Health System.

46 year old Dr. Bai Bai Ahmed Kabia, a graduate of Saint Francis Secondary School in Makeni Sierra Leone, proceeded to Russia after school in his home Sierra Leone and enrolled in medical school. Having graduated as a medical doctor from Rostov State Medical University, Dr. Kabia moved to UK in 1994 to start training in podiatry.

In order to obtain a job as a medical doctor in the UK's National Health System, Bai Bai Kabia wrote over 1000 applications, lying about his medical experience and even faking affiliations with professional medical associations and bodies. He was never successful in obtaining a job with the NHS.

Authorities started to investigate Bai Bai Kabia when they noticed that many of his applications were full of exaggerated claims which were found to have no credibility. He was also very persistent, coming up with different claims for different jobs. He stated in one instance that he was a registered General Medical Council Doctor, was a member of the Royal College of Physicians, had a MSc from University College London.
Bai Bai Kabia, thinking that he was not getting jobs in UK because his qualifications were not good enough, made even more outrageous claims on each new application. In 2013, a particularly bogus claim during an interview caused the Plymouth Hospitals NHS Trust to contact NHS Protect, the organization that monitors fraud in the NHS. NHS Protect then proceeded to investigate past applications by Bai Bai Kabia across the United Kingdom and discovered 1000 fraudulent applications he had made full of misrepresentations and bogus claims.
At his sentencing the judge said, "This was a persistent, deliberate and relatively sophisticated fraud, aimed at obtaining employment for which you were not trained or qualified in the NHS, The gravidum of the frauds is the danger to which patients of the NHS would have been exposed if any of the applications had been successful"
Bai Bai Kabia was accused of "breathtaking arrogance." An anti-fraud Specialist working at NHS Protect, Dave Horsley, said, "Dr Kabia submitted job applications that he knew to be false, trying to deceive his potential employers."Had he been successful, Dr Kabia's appointment would have given him direct access to treat patients. The custodial sentence reflects the seriousness of these offences and will serve as a powerful deterrent to others."
Many Sierra Leoneans are wondering why Bai Bai Kabia after all these rejections did not just return to Sierra Leone where there was such a shortage of doctors. One observer even said, "this fellow comes from the same area as President Koroma and they even share the same first name. He could have been a cabinet minister, as these are the type of people the President likes to hire. I don't know why he put himself through all this when he could have been a big man if he had come home."
The Segbwema Blog correspondent is not sure whether Dr. Bai Bai Kabia will appeal, but many Sierra Leoneans think he will likely go home after his jail term.

All Peoples Congress Deeply Divided by Third Term Debate

The third term debate for Sierra Leone's increasingly polarizing President Ernest Bai Koroma, ignited by some people close to him and other political opportunists scared of losing their political positions if he leaves office, has not only brought a lot of tension into the fragile West African state, but has also brought bitter divisions between members of the ruling All Peoples Congress (APC), most of who feel the President has played a great role in the country but needs to make way for new leadership and those who feel their political destinies are tied to the boot strings of Ernest Koroma.

Already some prominent members of the APC in the diaspora have broken ranks with Rev. Kabs Kanu, the main American proponent of the limitless term agenda and called the move selfish, parochial and a refusal to learn from the lessons of recent history. Some APC supporters have taken to online news outlets radio waves and Internet forums to appeal to President Koroma to not let the personal ambitions of a few bring conflict into a country that has just emerged from a decade of bitter conflict. Lawyer Alieu Iscandari who famously took the New People online newspaper to court in US and lost, a committed APC supporter also came out rejecting the move on social media.

Writing in a pro-APC government news outlet, US based Dr Francis Dumbuya, a staunch APC loyalist wrote that as much as citizens have the right to free speech, the government is also duty bound to do the right thing. He opines that " to tamper with the constitution in order to favor a third presidential term for the a President is wrong, and the President must resist all calls to do so." Dr. Dumbuya was reacting to the expressed opinion of the President's Special Executive Assistant Sylvia Blyden, one of the people leading the charge for a third term with the provision of "if it is what the people desire."

Dr. Dumbuya states that the same Sylvia who is now calling for free speech for selfish motives is the same Sylvia who just a few months ago was advocating for the use of the country's outdated libel laws to muzzle press freedom in the country. This inconsistency was not only dishonorable, but purely self serving on the part of the political chameleon Blyden.

On Social media the call by APC loyalists for the President to not allow himself to be misled by a handful of political opportunists is on the increase and already there are conspiracy theories as to the true intentions of these so call third term advocates. A poll on the Voices of Sierra Leone forum as to whether the President should have a third term already has about 90% of the respondents saying no,  many of them staunch APC supporters.

One conspiracy theory surrounding the Sierra Leone third term debate is that APC knows that the main opposition Sierra Leone Peoples Party is deeply divided with too many candidates for the leadership of the party and are therefore using the third term debate as a distraction and diversionary tactic, while the President manipulates his party to leave his chosen people at the helm and ensure a third term for his party when he exits in 2018.

Another theory is that the current constitutional review process will be used to reintroduce a parliamentary style of government, bringing back the position of Prime Minster, thereby making the Presidency a largely ceremonial position. As leader of APC the largest party in Parliament, Ernest Koroma will automatically become Prime Minister and not have to run for another Presidential term. He will therefore be in a position to maintain the interest of his friends and cronies without having to once again face the people on a national campaign. Other APC supporters are of the opinion that cross party defectors with no deep loyalty to APC are using the third term debate to destroy the party of their forebears. One prominent party activist opined that it is very sinister that Robin Fallay, Sylvia Blyden, John Leigh and all the individuals now praising Ernest Koroma from the rooftops were just a few years ago some of his staunchest critics.

As an opposition parliamentarian Robin Fallay ridiculed Ernest Koroma as the most ineffectual leader in Africa and Sylvia Blyden painted the caricature of the President as a womanizing buffoon and a weak leader, even referencing the color of his underwear and ridiculing his girlfriends in her Awareness Times tabloid. For these people to now suddenly be the ones advocating for a third term is seen more as a ploy to create divisions within the party than genuine love for a party.

Speaking to the blog on the condition of anonymity, a prominent Sierra Leone based APC supporter stated that many top party supporters were disgruntled by the sort of influence the President is now under, and his failure to come out to forcefully dispel these third term rumors. He said there were many party officials who were considering throwing their hats into the ring, but couldn't do so as they were afraid of recriminations and victimization by the President's cronies, as he seemed unable to say no to them.

"President Koroma used to have an open door policy for us all," he said, "but he now surrounds himself with yes men, political opportunists and people who are nothing without him" According to the confidential source, President Koroma has grown very suspicious of people around him, as he is now subject to bad counsel everyday.

People like Sylvia Blyden, he said, are making the a President suspicious of even his close friends. Her recent "juju discovered at her house antics" was just an excuse to confirm to a very superstitious President that people are out to get them by mystical means. Even some if the President's own family members are worried by the type of hold these new "APC" folks have on him.

As the debate continues, many Sierra Leoneans are adamant that no third term will be allowed. One civil society leader said on radio  that civil society will resist any move to have President Koroma go for a third term and many are already going with the slogan "After Gbagbo Nar U," in response to the t-shirts and banners suddenly springing up everywhere proclaiming after "U nar U."

Many APC members are publicly wondering why President Koroma would want to soil his legacy when many people in the country recognize the many things he has done to continue developmental strides in the country. One APC activist stated that it is better to leave a speech when the people are still clapping, than do so when they are no longer interested in listening to your voice.

Already the third term debate has become a distraction in the country and masking the secondterm efforts of Ernest Bai Koroma. Many fear a return to the bad old days if the President allows himself to succumb to the ambitions of a few unpatriotic allies who only care about their own positions and could care less about national stability and security.
